General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Withdrawal Period: the period within which the consumer may exercise their right of withdrawal; 30 days.
  • Consumer: the natural person acting for purposes outside their trade, business, craft, or profession, who enters into a distance contract with the trader.
  • Day: calendar day.
  • Durable Medium: any means that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
  • Right of Withdrawal: the option for the consumer to withdraw from the distance contract within the withdrawal period; 30 days.
  • Trader: Halcyon Label, the natural or legal person offering products and/or services to consumers at a distance.
  • Distance Contract: a contract concluded within an organized system for distance selling, using one or more techniques for distance communication (e.g., website, email).
  • Technique for Distance Communication: means used to conclude a contract without the consumer and trader being in the same place at the same time.
  • General Terms and Conditions: these terms and conditions of Halcyon Label.

Article 3 – Applicability

These general terms and conditions apply to every offer made by Halcyon Label and to every distance contract concluded between Halcyon Label and the consumer.

Before concluding a distance contract, these terms will be made available to the consumer. If this is not reasonably possible, Halcyon Label will indicate where they can be accessed and will provide them free of charge upon request.

If the contract is concluded electronically, these terms may be provided electronically in a way that allows storage on a durable medium.

If additional product or service conditions apply, the consumer may always rely on the provision most favorable to them in case of conflicting conditions.

If any provision is found invalid, the remaining provisions remain in effect, and the invalid provision will be replaced with one that reflects the original intent as closely as possible.

Situations not covered by these terms will be interpreted in the spirit of these terms.

Article 4 – The Offer

  • Offers with limited validity or conditions will be clearly stated.
  • All offers are non-binding. Halcyon Label reserves the right to modify or withdraw offers.
  • Product descriptions are accurate and sufficiently detailed. Images are representative but may vary slightly.
  • Obvious errors or mistakes are not binding.
  • Prices exclude customs duties and import VAT, which are the customer’s responsibility.
  • Additional information provided includes:
    • Shipping costs
    • Contract formation steps
    • Right of withdrawal
    • Payment and delivery methods
    • Offer validity
    • Available languages
    • Product specifications (size, color, materials)

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions.

Electronic acceptance will be confirmed by Halcyon Label. Until confirmation, the consumer may cancel the contract.

Halcyon Label takes appropriate technical and organizational measures to secure electronic transactions.

Orders may be refused or subject to additional conditions if justified (e.g., payment concerns).

The consumer will receive, on a durable medium:

  • Contact details for complaints
  • Withdrawal conditions
  • Warranty information
  • Contract details

All agreements are subject to product availability.

Article 6 – Right of Withdrawal

Consumers may withdraw from a purchase within 30 days of receiving the product without providing a reason.

During this period, the product must be handled carefully. If returned, it should be in original condition and packaging, with all accessories included.

The consumer must notify Halcyon Label within 30 days (e.g., via service@halcyonlabel.com) and return the item within 30 days after notification.

Failure to comply makes the purchase final.

Article 7 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer.

Any payments made will be refunded within 30 days after withdrawal, provided the returned product has been received or proof of return has been provided.

Article 8 – Exclusion of Right of Withdrawal

The right of withdrawal may be excluded for:

Products:

  • Custom-made or personalized items
  • Items of a personal nature
  • Non-returnable goods
  • Perishable goods
  • Products with fluctuating prices
  • Sealed hygiene products once opened

Services:

  • Services with a specific date (e.g., travel, events)
  • Services started with consumer consent
  • Gambling or lottery-related services

Article 9 – Price

Prices will not increase during the validity period, except for VAT changes.

Prices may vary for products linked to financial markets.

Delivery outside the EU may result in import VAT and customs duties charged by the carrier.

All prices are subject to typographical errors.

Article 10 – Conformity and Warranty

Halcyon Label guarantees that products conform to the agreement and legal requirements.

Warranty does not affect statutory consumer rights.

Defects must be reported within 30 days. Returned items must be unused and in original packaging.

Article 11 – Delivery and Performance

Delivery is made to the address provided by the consumer.

Delivery time is a maximum of 30 days unless otherwise agreed.

If delayed, the consumer will be informed.

Article 12 – Payment

Payments must be made using the methods provided.

Consumers are responsible for correcting incorrect payment information.

Payments are made in advance unless otherwise agreed.

Article 13 – Complaints

Complaints must be submitted within 30 days after discovering a defect.

Article 14 – Complaint Handling

Complaints must be submitted in writing via service@halcyonlabel.com.

Halcyon Label will respond within 30 days.

If unresolved, disputes are subject to applicable dispute resolution procedures.

Valid complaints will result in repair or replacement free of charge.

Article 15 – Disputes

All agreements between Halcyon Label and the consumer are governed exclusively by Dutch law, regardless of the consumer’s place of residence.
